Nokia ($NOK) Steps-Up its Patent Fight with Apple ($AAPL)

Nokia Corp. (NYSE: NOK) on Friday said it has sued Apple (NASDAQ: AAPL) in federal court for the Western District of Wisconsin, alleging that iPhone and iPad 3G infringed five separate Nokia patents.

According to the report, the patents in question relate to �enhanced speech and data transmission, using positioning data in applications and innovations in antenna configurations that improve performance and save space, allowing smaller and more compact devices.�� These patented innovations are important to Nokia’s success as they allow improved product performance and design.

�Nokia has been the leading developer of many key technologies in mobile devices� Paul Melin, general manager, Patent Licensing at Nokia, said in a statement. �We have taken this step to protect the results of our pioneering development and to put an end to continued unlawful use of Nokia�s innovation.�

The Finnish cell phone maker’s latest filing follows a similar move in October last year when it charged Steve Job’s company of infringing 10 patents. Nokia reportedly demanded royalties on the more than 51 million iPhones sold since the device came out in 2007. Two months later, Apple responded by filing a countersuit claiming that Nokia had infringed 13 of Apple’s own patents.

Steve Dowling, a spokesman for Apple, declined to comment on the new case.

Since Apple entered the smartphone market three years ago, Nokia has apparently lost its position as a top notch innovator in the high-end smartphone market. Nokia has established itself as a leader in the development of handheld device and mobile communications technologies, which is demonstrated by its strong patent portfolio. However, the Espoo, Finland-based company lagged behind Apple in developing touch screens featured on iPhone and on the iPad which was just released this year. In a seemingly backward move, Nokia announced last month that it is delaying its latest software update for its phones, much to the disappointment of investors.

Weighing in on the issue between the two technology giants, Broadpoint AmTech analyst Brian Marshall, in a report by Reuters, was quoted as saying: “I think the Nokia/Apple lawsuits are a lot of noise. At the end of the day, they are both tech-rich companies with tremendous IP and are probably both “borrowing” each others’ technology to some extent. My guess is this lasts for years and they both issue some cross licenses to each other.”

Nokia�s filing on Friday helped push Apple shares down 4.22% to $235.86. Nokia dropped 4.19% to $10.75.
